Article 1 – Purpose

These General Terms and Conditions of Sale define the conditions under which SUPER NANA PRIDE sells its products on its website to consumers.

Any order placed on the website implies full and unconditional acceptance of these Terms and Conditions.

Article 2 – Products

The products offered for sale are those displayed on the website at the time the customer consults the site, subject to availability.

SUPER NANA PRIDE strives to present the products as accurately as possible. However, photographs, visuals, textile renderings, colors displayed on screens and styling images are non-contractual and cannot engage the liability of SUPER NANA PRIDE, particularly in the case of minor variations in shade, texture, print, cut or finishing.

Customers must carefully read the description of each product before placing an order.

Article 3 – Prices

Prices are indicated in euros.

As SUPER NANA PRIDE operates under the French micro-enterprise tax regime, VAT is not applicable in accordance with Article 293 B of the French General Tax Code.

Prices displayed on the website do not necessarily include shipping costs. Shipping fees are indicated before final confirmation of the order.

SUPER NANA PRIDE reserves the right to modify its prices at any time. Products are invoiced based on the price applicable at the time the order is confirmed.

Article 4 – Orders

Customers select the products they wish to purchase, add them to their cart, and confirm the order after verifying its details.

An order is considered final only once payment has been validated.

SUPER NANA PRIDE reserves the right to refuse, cancel or terminate any order in the event of an existing dispute with the customer, suspicion of fraud, abuse of the right of withdrawal, clearly incorrect delivery information or any legitimate reason.

Article 5 – Payment

Payment is due in full on the day the order is placed.

Accepted payment methods may include credit card, PayPal, Apple Pay and Google Pay.

Payments are secured through the website’s technical payment providers. SUPER NANA PRIDE never has access to the customer’s full banking details.

If payment authorization is refused by the relevant financial institutions, the order will be automatically cancelled.

Article 6 – Availability

Product offers are valid as long as they are visible on the website and while stocks last.

If a product becomes unavailable after an order has been placed, the customer will be informed as soon as possible. The order may be cancelled and the amounts paid will be refunded.

Article 7 – Delivery

Products are delivered to the address provided by the customer when placing the order.

The customer is solely responsible for the accuracy of the delivery information provided. In the event of an error, incomplete address, incorrect name, inaccessible mailbox, repeated absence, failure to collect a parcel at a relay point or any information preventing proper delivery, the costs related to reshipping the order will remain the responsibility of the customer.

Orders are prepared within 2 to 5 business days after payment confirmation, unless otherwise stated.

Delivery times are provided for information only. A reasonable delay attributable to the carrier cannot result in automatic cancellation of the order, compensation or reimbursement of shipping costs unless otherwise required by law.

Deliveries may be made within mainland France, the European Union and internationally depending on the destinations offered on the website.

Shipping costs are calculated at checkout depending on the weight of the parcel, the destination and the carrier.

SUPER NANA PRIDE does not offer free shipping unless explicitly stated on the website.

Article 8 – Receipt of the Order

Customers must check the condition of the parcel and the products upon delivery.

Any visible anomaly, damaged parcel, missing item or damaged product must be reported in writing to SUPER NANA PRIDE within 48 hours of receipt, with photographs provided as evidence.

After this period, any claim relating to visible transport damage may be rejected.

Article 9 – Right of Withdrawal

In accordance with consumer protection laws, the customer has a legal period of 14 days from receipt of the order to exercise their right of withdrawal without providing any reason.

To exercise this right, the customer must notify their decision in writing to the following address: supernanapride@gmail.com.

The customer must then return the products within 14 days after sending the withdrawal request.

Return shipping costs remain the responsibility of the customer.

The burden of proof regarding the exercise of the right of withdrawal lies with the customer.

Article 10 – Product Return Conditions

Returned products must be sent back in a condition allowing them to be resold.

Items must not be worn beyond simple fitting, must not be washed, stained, damaged or perfumed, and must not carry odors such as detergent, perfume, smoke, sweat or any other smell.

Items must be returned with their original tags, accessories, packaging and components when applicable.

SUPER NANA PRIDE expressly informs customers that clothing may be tried on but must not be worn in conditions exceeding what is necessary to verify its nature, characteristics and size.

Any item returned stained, washed, perfumed, clearly worn, damaged, excessively wrinkled, without tags or otherwise unsuitable for resale in new condition may result in refusal of reimbursement or partial reimbursement corresponding to the depreciation suffered, as permitted by law.

No refund will be issued for an item returned in a condition that renders it unsellable.

Article 11 – Refund

If the right of withdrawal is validly exercised, SUPER NANA PRIDE will refund the amounts paid for the returned products, excluding return shipping costs, within a maximum of 14 days from the date on which it is informed of the withdrawal.

However, SUPER NANA PRIDE may delay the refund until the goods have been received or until proof of shipment has been provided by the customer, whichever occurs first.

The refund will be made using the same payment method used for the order unless expressly agreed otherwise.

Initial shipping costs are reimbursed only up to the amount corresponding to the standard delivery method offered.

Article 12 – Exceptions to Returns

Unless otherwise required by law, the following items cannot be returned: personalized items, items made according to the customer's specifications, sealed items that cannot be returned for hygiene or health protection reasons once opened, and items returned incomplete, damaged, worn or unsuitable for resale.

Article 13 – Legal Warranty

Customers benefit from the legal warranty of conformity and the legal warranty against hidden defects as provided by law.

These legal warranties apply independently of any commercial warranty that may be granted.

Consumers may invoke the legal warranty of conformity under Articles L.217-3 and following of the French Consumer Code and the warranty against hidden defects under Articles 1641 and following of the French Civil Code.

Article 14 – Liability

SUPER NANA PRIDE cannot be held liable for damages resulting from improper use of the products, normal wear and tear, improper maintenance, customer fault, unforeseeable acts of third parties or cases of force majeure.

SUPER NANA PRIDE shall also not be liable for disruptions, interruptions or bugs related to the internet network, the website, payment platforms or external logistics services.

Article 15 – Personal Data

Personal data collected in the context of orders is processed in accordance with the website’s Privacy Policy.

Article 16 – Consumer Mediation

In accordance with consumer protection regulations, customers have the right to use a consumer mediator free of charge in order to resolve disputes amicably.

This section must be completed before publication with the mediator actually chosen by the company.

After a prior written complaint submitted to SUPER NANA PRIDE, the mediator service may be contacted for any consumer dispute that has not been resolved.

Article 17 – Applicable Law and Disputes

These Terms and Conditions are governed by French law.

In the event of a dispute, an amicable solution will first be sought.

Failing amicable agreement or mediation, French courts shall have exclusive jurisdiction, subject to mandatory consumer protection rules.
